  • Insult or make derogatory remarks to a debtor
  • Continue contacting a debtor after being asked to contact the debtor’s attorney

Although you are entitled to the rights listed above, enacting them does not mean you don’t have to pay back the debt, it only means you don’t have to worry about the calls anymore.

Request Proof of Your Debt

When a debt collector contacts you, ask for proof of the debt they are inquiring about. Don’t make any payments on the debt until you verify that it is valid and accurate. Debt can sometimes be applied to the wrong account or the amount may be inaccurate, so make sure you obtain documentation of the debt from the collector. You should also check to see if the collector is authorized to collect the debt.

Negotiate Repayment

Some creditors might be willing to work with you to come up with a repayment plan to pay off your debt. Whether it’s paying one large lump sum payment or smaller payments overtime, you should try to negotiate a deal that won’t exhaust all of your funds.
