How To Stop Creditor Harassment

Being in debt is a frustrating experience on its own, but when you throw in the constant harassment of creditors, it can make a bad situation even worse. The fact is that there are some things you can do to reduce the calls you receive or eliminate them altogether, but it will not happen on its own.

Understand Your Rights

Collectors do not have free rein to do whatever they want, so it is important to understand your rights and know what creditors can and cannot do. For example, they are not allowed to call you before 8 am or after 9 pm unless you have given them permission, so be sure to set boundaries when you initially speak to them on the phone. You can also tell them that they cannot contact your employer or your family. Additionally, federal law requires that these notices must be provided in writing, so follow-up with a certified letter to ensure it is legally in effect.

Creditors are prohibited from doing the following under the Fair Debt Collections Practices Act:

  • Engaging in any form of deceptive conduct
  • Calling you repeatedly
  • Calling you at work despite you asking them not to
  • Calling you during unreasonable hours
  • Contacting your family, friends, neighbors, or employer and mentioning the debts you owe
  • Publishing your name
  • Threatening a loss of your welfare benefits, child custody, or threatening arrest
  • Making derogatory or obscene comments
  • Contacting you after you have already secured legal representation and have directed the collector to contact your attorney

If a collector or creditor violates any of these laws, you have a right to sue them for damages.
