Bankruptcy Litigation Issues

The following are examples of disputes that can arise during bankruptcy and require litigation. We are equipped to represent debtors in the following cases, among others:

Automatic Stay Violations – If a creditor has attempted to collect debt after the debtor has filed for bankruptcy, the debtor may choose to sue the creditor. After filing for bankruptcy, debtors are protected by the automatic stay, which prohibits creditors from collecting debt anymore.

Disputes over dischargeability of debts – A creditor may challenge the court’s decision to discharge certain debts. Likewise, a debtor may challenge the court’s decision to regard a debt as nondischargeable.

Claims objections – If a creditor presents false information on his or her proof of claim, the debtor can file an objection. A hearing date will be set, and if the creditor fails to respond within 30 days of the hearing, the debtor’s objection will be upheld. If the creditor does respond, the matter will be brought before the bankruptcy judge.

Fraudulent Transfers – A fraudulent transfer occurs when a debtor transfers property during the bankruptcy process in an attempt to defraud creditors. This might involve hiding assets or doing anything to encumber the process of collection. We represent and defend the rights of debtors who have been accused of fraud.

Valuation Disputes – If a company files for bankruptcy, it is necessary to properly valuate all of the business’ assets to determine what can be repaid to creditors. The matter can be brought to litigation if there are disagreements regarding the proper valuation of these assets.
